Public Offer Agreement for Gasanova

GENERAL PROVISIONS

individuals, to conclude a purchase and sale agreement with the Seller for goods via remote means through the online store at the website: gasanova.ua/en under the conditions set forth in this Offer.

1.2. Goods or Services – The object of the agreement between the parties, selected by the Buyer on the website of the online store and added to the cart, or already purchased by the Buyer from the Seller via remote means.

1.3. Online Store – The Seller's website at the address gasanova.ua/en, created for the conclusion of retail and wholesale purchase and sale agreements based on the Buyer's acquaintance with the product description provided by the Seller via the Internet.

1.4. Buyer – Any legally capable individual who, in accordance with the procedure provided in this Agreement, has voluntarily and fully accepted (accepted) all of its terms without exception.

1.5. Seller – Sole Proprietor Yuliia Volodymyrivna Sushko (Tax ID 3149013366), located at 2 Prykarpatska Street, Nyzhcha Dubechnya village, Vyshhorod district, Kyiv region, 07361, Ukraine

The Seller may also be another legal entity or sole proprietor who publishes information about the goods it sells on the Site under a licensing agreement with the Owner of the Trademark Elivira Damirova (Gasanova). The Seller's name is indicated in the product card on the website and in the documents for the transfer of goods to the Buyer.

1.6. Gasanova operates on a retail basis, with return procedures governed by the "On Protection of Consumer Rights" law.

1.7. By placing an order, the Buyer agrees to adhere to the terms of this Agreement and confirms they have read and understood them.

CONCEPTS AND DEFINITIONS

2.1. In this offer:

  • Goods - clothing, accessories, and related items;

  • Online store - a platform for presenting or selling products via electronic transactions;

  • Seller - the entity selling products listed on the website;

  • Buyer - an individual who accepts the Seller's terms to purchase Goods;

  • Order - a Buyer-selected assortment of Goods with payment completed.

SUBJECT OF THE CONTRACT

3.1. The Seller agrees to transfer the Goods to the Buyer, and the Buyer agrees to accept and pay for the Goods per this Agreement.

This Agreement governs:

  • The Buyer's selection and ordering process;

  • The Buyer’s payment of orders;

  • The processing and delivery of orders to the Buyer.

ORDERING PROCEDURE

4.1. The Buyer can order any product available on the website.

4.2. Each item may be included in the order in any quantity.

4.3. If an item is unavailable, a Gasanova representative will inform the Buyer (by phone or email).

4.4. The Buyer can opt to replace an unavailable item with a similar model.

4.5. Orders are placed by adding items to the “Cart.”

4.6. An order is valid if:

  • Buyer provides accurate personal information, delivery address, contact number, email, preferred payment method, and delivery type.

ACCEPTANCE OF ORDER BY GASANOVA

5.1. The online store verifies availability and contacts the Buyer to confirm details.

5.2. Once confirmed, changes or cancellations are only allowed before payment. After payment, order changes or removals are not permitted.

ORDER FORMATION

6.1. Orders placed and confirmed by 14:00 are dispatched the same day. Orders made on weekends or holidays are processed the next business day. Sender’s city - Kyiv.

6.2. In the absence of Goods, a representative will discuss alternative options with the Buyer.

6.3. After order formation, the Buyer will receive a status update and payment method instructions via email.

PAYMENT METHODS

7.1. Payment options include:

  • Cash on delivery at Nova Poshta

  • Card payments online

  • Liqpay system

  • Cash for in-person pickups

Note: Payment processing fees for Nova Poshta and commissions for online payments are the Buyer’s responsibility.

DELIVERY TERMS

8.1. Delivery within Ukraine is conducted by Nova Poshta. For international deliveries, Ukrposhta is used. No delivery to Russia or Belarus.

8.2. Gasanova completes delivery by handing orders to the carrier, with risks transferred to the Buyer upon dispatch.

8.3. Free delivery is available within Ukraine under full retail purchase conditions. Discounted items may require Buyer-paid shipping.

8.4. Free delivery does not apply to specific categories: accessories, promotional items, and charity items.

8.5. Separate items within a single order may incur additional delivery charges.

8.6. Order dispatch occurs within 1-3 business days upon order receipt, subject to availability.

RETURN POLICY

12.1. Returns are accepted at the original purchase location.

12.2. Items of good quality may be returned or exchanged within 14 days if unworn, with intact packaging and tags.

12.3. Damaged items or those lacking original packaging or tags cannot be returned or exchanged.

12.4. The return procedure requires a completed return form and item shipment to the designated address.

CONTRACT TERM

13.1. The electronic contract is concluded upon the Buyer’s acceptance per the Law of Ukraine "On Electronic Commerce."

13.2. Contract termination is only possible by mutual agreement prior to payment.

13.3. Gasanova reserves the right to modify the Agreement terms by posting updates on the website.
